These terms apply to everyone who uses Nestinga, the website at nestinga.com, run by Nestinga, South Civil Lines, Roorkee, District Haridwar, Uttarakhand 247667, India ("Nestinga", "we", "us"). By creating an account or using Nestinga you agree to them. Hosts also agree to the Host terms. How we handle personal data is in the Privacy policy.
These terms are an electronic record under India's Information Technology Act, 2000 and the rules under it, and are published as Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 requires. They don't need a physical or digital signature.
1. What Nestinga is
Nestinga is an online marketplace. Independent hosts (retreat centres, teachers, organisers) list retreats, trainings, courses and events, and guests find and book them here. Nestinga is an intermediary under the Information Technology Act, 2000 and a marketplace e-commerce entity under the Consumer Protection (E-Commerce) Rules, 2020.
Your contract for a retreat or event is with its host, not with Nestinga. Each listing names its host and shows the business details the host gave us. Nestinga doesn't organise, run or check the retreats and events themselves.
2. Your account
- You must be 18 or older to create an account, and give true and complete details.
- Keep your password private. You're responsible for what's done with your account; tell us at once if you think someone else has used it.
- You can download your data or delete your account from your profile at any time.
3. Booking
Prices are shown as the host sets them; Nestinga adds no fee for guests. Many listings take enquiries: you send your dates, a phone number and a message, agreeing that the host receives your name, email and phone, and the host replies to arrange the booking with you. On some hosts' plans Nestinga checks an enquiry before passing it on, to keep spam and scams away. Other listings book online, instantly or as a request the host has 48 hours to accept. Free places can be booked online straight away.
4. Payments
You pay the host directly, in the way they offer (for example a bank transfer, their payment link or their own card payments). Nestinga doesn't take or hold your money and isn't a party to the payment; the host gives you the receipt or invoice. Before you pay, agree the dates, the price, what's included and the cancellation terms with the host in writing. Never pay anyone who asks you to pay outside the arrangements shown or agreed with the host on Nestinga, and tell us about such requests.
5. Cancellations and refunds
Each listing shows its cancellation policy before you book:
- Flexible: full refund up to 30 days before the start, 50% from 15 to 29 days, none after that.
- Moderate: full refund up to 60 days before the start, 50% from 30 to 59 days, none after that.
- Strict: 50% refund up to 90 days before the start, none after that.
- Non-refundable: no refund.
Refunds are made by the host, who took your payment, under the policy shown on the listing; if the host cancels, you get back everything you paid. Free bookings can be cancelled online from your booking page. These policies don't take away any rights you have under consumer protection law.
6. Reviews and messages
Only guests of a completed booking can review it, within 90 days. Reviews must be honest and about your own experience. Messages hide contact details until you've sent the host an enquiry or have a paid booking, to protect both sides from spam and scams.
7. What you may not do
You may not use Nestinga to host, display, upload, change, publish, send, store, update or share anything that:
- belongs to someone else and you have no right to;
- is obscene, pornographic, paedophilic, invades someone's privacy (including bodily privacy), insults or harasses anyone on the basis of gender, is racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on the grounds of religion or caste with the intent to incite violence;
- is harmful to children;
- infringes a patent, trademark, copyright or other proprietary right;
- deceives or misleads anyone about where a message comes from, or knowingly and intentionally shares false or misleading information, or information that is patently false and untrue;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, incites any offence, prevents the investigation of an offence, or insults another nation;
- contains a software virus or any other code, file or program meant to interrupt, destroy or limit any computer resource;
- breaks any law in force.
Nor may you commit fraud, send spam enquiries, scrape or copy Nestinga's content in bulk, interfere with its security, or use another person's account.
If you break these rules we may remove or disable the content, and suspend or close your account. We tell you what we did, why, and how to challenge the decision. Where the law requires, we keep records of it and report it to the authorities.
8. Reports and complaints
Anyone can report a listing from its page ("Report this listing"). A person at Nestinga reviews every report and tells the reporter (and, if we act, the host) what we decided and why.
For any other complaint, including about content, your personal data or our service, write to our Grievance Officer (details in section 14). We acknowledge complaints within 24 hours and resolve them within 15 days; a request to remove content that breaks section 7 is resolved within 72 hours. A request to remove content that exposes a person's private areas, shows them in full or partial nudity or in a sexual act, or is an impersonation in an electronic form, including artificially morphed images, is acted on within 24 hours. If you're in India and aren't satisfied with the Grievance Officer's decision, you can appeal to the Grievance Appellate Committee at gac.gov.in within 30 days of it.
9. Nestinga's liability
- Hosts are responsible for their retreats and events, including what they promise, safety, accuracy, permits, insurance and refunds. Nestinga isn't responsible for a host's acts or omissions, but we will help you reach the host and act on listings that break these terms or the law.
- We work to keep Nestinga available and secure, but provide it "as is" and can't promise it will always be uninterrupted or error-free.
- As far as the law allows, Nestinga isn't liable for indirect or consequential loss, and our total liability to you for any claim is limited to the amount you paid Nestinga in the 12 months before it, or ₹10,000 if you paid us nothing.
- Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud or for death or personal injury caused by negligence, or your rights as a consumer.
- Neither side is responsible for failing to perform because of events beyond reasonable control, such as natural disasters, epidemics, war, government action or failures of networks we don't control.
10. Your responsibility to us
If you break these terms or the law and someone makes a claim against Nestinga because of it, you will make good the loss and reasonable costs that this causes us, as far as the law allows.
11. Suspension and ending
You can stop using Nestinga and delete your account at any time. We may suspend or close an account that breaks these terms or the law, or to protect guests, hosts or Nestinga, and we tell you why. Bookings already made stand unless the host cancels them under their policy.
12. Changes
We may change these terms. We'll tell you before changes take effect and ask you to accept the new version next time you sign in; the version you accepted is recorded.
13. Law and disputes
These terms are governed by the laws of India. Subject to the next sentence, the courts at Haridwar, Uttarakhand, India have exclusive jurisdiction. If you're a consumer you keep every right the law gives you: in India, for example, to bring a complaint before the Consumer Commission where you live or work under the Consumer Protection Act, 2019; outside India, the protection of the mandatory law of the country you live in. If something goes wrong, please contact us first: we answer within 2 working days.
